MARKANIN KULLANILMAMASI SEBEBİYLE HÜKÜMSÜZLÜĞÜ

Abstract

Türkiye’de markalarla ilgili temel düzenleme 556 sayılı Markaların Korunması Hakkında Kanun Hükmünde Kararname’dir.1 KHK m. 14 fıkra 1’e göre, “Markanın, tescil tarihinden itibaren beş yıl içinde, haklı bir neden olmadan kullanılmaması veya bu kullanıma beş yıllık bir süre için kesintisiz ara verilmesi halinde, marka iptal edilir.” Markanın kullanılması olgusunu, marka sahibi tarafından, yurt içinde, markanın tescil edildiği mal veya hizmetlerde, tescil amacına yönelik, süreklilik arz eden, ciddi, aktif ve markaya özgü kullanma fiilleri belirler.2 KHK m. 14 fıkra 1’e göre markanın tescil tarihinden itibaren beş yıl içinde haklı bir neden olmadan kullanılmaması halinde marka iptal edilir. Bu anlamda haklı neden yetkili makamlarca alınan önlemler sonucu üretim yapılamaması, ilgili malın satışa sunulması için gerekli iznin verilmemesi gibi marka sahibinin etki alanı dışında kalan olaylardır.3 KHK m.14 fıkra 2’ye göre, “Aşağıda belirtilen durumlar markayı kullanma kabul edilir: a. Tescilli markanın ayırt edici karakterini değiştirmeden markanın farklı unsurlarla kullanılması,b. Markanın yalnız ihracat amacıyla mal ya da ambalajlarında kullanılması, c. Markanın, marka sahibinin izni ile kullanılması, d. Markayı taşıyan malın ithalatı.” KHK m.42 fıkra 1 c bendine göre, m. 14’teki kullanım zorunluluğuna uyulmaması halinde mahkemece markanın hükümsüzlüğüne karar verilecektir.

Basic edition about trademarks is Law No. 556 on Decree Law on Protection of Trademarks in Turkey. The 1st subsection of the 14th article of Decree Law, “a trademark that has not been put to use without a justifiable reason within a period of five years following registration, or if the use has been suspended during an uninterrupted period of five years, the trademark shall be cancelled.” Intended to purpose of registration, ongoing, serious, active and using trademark-specific verbs determine the using of trademark, by the trademark owner in domestic in goods and services which have been registered the trademark. According to the subsection 1st paragraph of the 42th (ı) article of Decree Law, in case of not obeying obligation of use disobeyed in 14th article, trademark shall become null and void.
