Fiziksel Çocuk İstismarının İncelenmesi

Abstract

Çocuk istismarı, bir yetişkin tarafından belli bir dönemde çocuğa o kültürde kabul edilmeyen bir davranışın uygulanmasıdır. Genel olarak çocuğun büyüme ve gelişmesini olumsuz yönde etkileyen her türlü davranış olarak tanımlanmaktadır. İstimara maruz kalan çocukların acil servislere daha çok düşme ve ev kazaları nedeniyle getirildikleri görülmüştür. Çocuk istismarının açık olarak teşhisi söz konusu olmadığı için çocuk yaş grubundaki olgularda travma ile karşılaşınca şüphe ile yaklaşmak gerekmektedir. Ayrıca hastanelerde kurulacak çocuk koruma ve izlem merkezlerinde olguların tıbbi-hukuki ve sosyal değerlendirilmesi; acı çekerek ve defalarca öykü-muayeneyle değil, tek merkezden sıkıntı yaşamadan gerçekleştirilmelidir. Yasalarımızda çocuk istismarı ve ihmali ile ilgili olarak özel maddeler bulunmadığından ilgili maddeler çocuk istismarı konusunda yetersiz kalmaktadır. Bu nedenle yasa koyucu tarafından çocuk istismarının önlenmesi ve mağdurların tedavi edilip topluma kazandırılması için özel yasalar hazırlanmalıdır. Bu çalışmada; şüpheli fiziksel çocuk istismarı olgularının adli olarak değerlendirilmesi gerektiği belirtilerek, olguların istismar ve ihmal yönünden irdelenmesi, yaşanan tıbbi, hukuki ve sosyal sürecin incelenmesi amaçlanmıştır

Child abuse is the implementation of an unacceptable behavior to child by an adult in a certain period in different culture. Generally, the child abuse and neglect is defined as any kind of behavior that negatively affects the growth and development of the child. It is seen that children exposed to abuse are mostly brought to the emergency services because of the tumbling and home accidents. Since a subject in pediatric ages comes to emergency services with a trauma, it should be approached with suspicion. In addition, at the child protection centers in the hospitals, the medical, legal and social evaluation of the child must be carried out without distress in a single center, refraining from taking the recurrence story and making painfully examination of the cases. Our laws articles about the child abuse and neglect are inadequate because there aren't special items connected with the child abuse and neglect. Therefore, for the prevention of child abuse, the treatment and rehabilitation of victims, the special laws connected with the subject matter should be prepared by the legislator. In this study, it was aimed to emphasize the necessity of medicolegal examination for the suspicious child abuse and neglected cases and, to investigate the medical, legal and social process
