FIKHÎ AÇIDAN NİTELİKLİ CİNSEL SALDIRI (IRZA GEÇME)

Abstract

Bu makalede nitelikli cinsel saldırı suçu, fıkhî açıdan farklı boyutla- rıyla ele alınacaktır. Kavramsal çerçevede zorlama kapsamına gi- ren ikrah, cebir ve ızdırar kavramlarının nitelikleri ve aralarındaki farklar ortaya konmaya çalışılacaktır. Nitelikli cinsel saldırı (ırza geçme) başlığı altında suçun niteliği, unsurları, ispatı ve ceza in- fazı üzerinde durulacaktır. Özellikle karîne ve yemin gibi ispat vâsıtları konusunda fakihlerin görüşlerine dikkat çekilecek, bu arada davalının konumuna da dikkat çekilecektir. Konu ile bağlan- tılı diğer hususlar çerçevesinde ise fiilin doğurduğu malî sonuçlar, tarafların nikahları sorunu, çocuğun nesebinin sübutu, bu fiil so- nucu meydana gelen hamileliğin sonlandırılması gibi hususlara değinilecektir.

In this article, it will be discuss the crime of rape through its vari- ous aspects from the jurisprudential perspective. In the concep- tual framework, it will be put forth the concept of coercion, com- pel, and constraint through their quality and their differences. Un- der the title of the crime of rape, it will be give point to the nature of the crime of rape, its elements, proof, and punishment. About the subject of proof instrumentality such as indication and oath, it will be applied to the fuqaha’s views and at the same time to situ- ation of the respondent will be given an attention. In the fra- mework of the subject, other issues that are related with subject such as financial results, act of marriage, genealogy of child, to end the pregnancy which came from this crime will be mentioned.
