179 Numaralı Sivas Şerriye Sicili Transkripsiyon ve Değerlendirmesi

Abstract

Mahkemeler adaletin tecelli bulması adına kurulan ve her türlü davaların görülüp karara bağlandığı yerdir. Osmanlı Devleti’nde bu kimi zaman kadının evi kimi zaman cami olabilmekteydi. Davacı ve davalıların söz konusu davadaki söz haklarından sonra delil ve şahitlerin de dikkate alınmasıyla bir hükme bağlanmak suretiyle dava çözüme kavuşturulurdu. Osmanlı mahkemeleri kadı huzurunda gerçekleşmekte ve dava konuları özenle tutulmaktaydı. Bu dava kayıtlarının tutulması şer‘iyye sicilleri veya kadı sicilleri diye adlandırılan muhtevasında birçok belge türünü bulunduran defter türünün oluşmasını sağlamıştır. Şer‘iyye sicilleri içerisinde yer alan belge türleri arasında hüccet, i’lâm, tereke, ferman, berat, vakfiye vs. bulunmaktadır. 179 Numaralı Sivas Şer‘iyye Sicili’nin incelendiği bu çalışmada söz konusu sicilde yer alan belgelerin vekalet hücceti olduğu tespit edilmiştir. Muhtelif konular içermekle birlikte miras, alacak-verecek, nikah en sık vekalet verilen konular olmuştur.

Courts is the place where justice is manifested and all kinds of cases are seen and decided. In the Ottoman Empire this was sometimes a judge’s house or a mosque. After the plaintiffs and defendants' right to speak in the case in question, the case was resolved by taking into account the evidence and witnesses. The Ottoman courts were held in the presence of the judge and the subjects of the proceedings were kept diligently. Keeping these case records led to the formation of a type of book that contained many types of documents in the socalled Sharia registers or judge registers. The types of documents included in the Sharia registers include: court documents, ilamâm, probate, edict, was released, and foundation papers. In this study in which the Sivas Şer‘iyye register numbered 179 was examined, it was found that the documents in the said register were the power of attorney. Although it contains various issues, inheritance, receivable and wedding were the most frequently given issues by proxy.
