Kamu ve Özel hastane Sağlık Çalışanlarının Meslekleri İle İlgili Mevzuat Bilgisi Farkındalıklarının Ölçümü: Sivas Merkez İlçe Örneği

Abstract

sektörü gün geçtikçe branşlaşmanın artmasıyla birlikte, görev tanımlarının da çeşitlendiği, buna bağlı olarak gerek hizmet sunumu öncesi, gerek hizmet sunumu esnası ve gerekse hizmet sunumu sonrasında çıkabilecek problemlere çalışanlar olarak yasal sorumlulukların bilinç düzeylerine göre nasıl tepki verdikleri önem arz etmektedir. Sağlık çalışanları sağlık mevzuatında yer alan birçok yasa ve yönetmeliklerle görevlerini yerine getirmekte ve bu yasa ve yönetmeliklerde belirtilen görev tanımlarına göre çalışmalarını esas almak ve herhangi bir uygunsuzluk durumunda kendilerine verilen hakları ve yaptırımları bilmeleri gerekmektedir. Buna göre sağlık mevzuatımızda yer alan; 657 sayılı Devlet Memurları Kanunu, Tababet ve Şuabat-ı Tarzı İcrasına Dair Kanun, Sağlık Meslek Mensupları Görev Tanımları Yönetmeliği, Aile Hekimleri Yönetmeliği gibi birçok kanun ve yönetmelik hakkında bilgi sahibi olmalıdırlar. Tezin genel amacı tüm sağlık çalışanlarının hukuki bağlamda haklarının ve sorumluluklarının ne derece farkında olduklarını ölçmektir. Türkiye’ de sağlık hukuku kapsamında yer alan mevzuat ve kanunların sağlık çalışanları bağlamında yeterliliği ve söz konusu çalışanların tabii oldukları mevzuatlar hakkında bilgi düzeylerini ölçmek ve onlara bir farkındalık oluşturmak temel amaçtır. Araştırmanın evrenini Sivas ilinde bulunan üç hastanede görev yapan sağlık çalışanları oluşturmaktadır. Araştırmada örneklem seçimine gidilmemiş belirlenen bu kurumlarda görev yapan doktor, hemşire, ebe, sağlık tekniker/teknisyenlerinin tamamı araştırmanın evrenini oluşturduğundan tamamına ulaşılması hedeflenmiştir. Anket 19.09.2016-19.03.2017 tarihleri arasında Cumhuriyet Üniversitesi Eğitim ve Araştırma Hastanesi, Sivas Numune Hastanesi ve Özel Medicana Sivas Hastanesi’nde uygulanmıştır. Anket 7 tanesi demografik veri, 14 tanesi mevzuat bilgisini ölçen sorulardan oluşmuş olup anketin geçerlik güvenirliği 30 kişilik bir grupta uygulanarak yapılmış ve sonrasında toplamda 348 sağlık çalışanına ulaşılarak uygulanmıştır. Araştırmanın sonucu iki kısımda incelenerek; birinci kısım mevzuat içindeki farklılıklar, ikinci kısım ise demografik verilere göre sorulara verilecek cevaplar arasındaki anlamlılık ilişkilerini değerlendirmektir.

It is important that how the health sector reacts according to the level of consciousness of the legal responsibilities as the employees, as the day-by-day increase in branching, the definition of the job descriptions, and accordingly the problems before service delivery, service delivery and post service delivery. Health workers are obliged to fulfill their duties under many laws and regulations in health legislation and to work on the basis of their job descriptions stated in these laws and regulations and to know the rights and sanctions given to them in case of any nonconformity. Accordingly, our health legislation; They should be informed about many laws and regulations such as the Civil Servants Law No. 657, the Law on the Practice of Medicine and Medicine, the Regulation of Terms of Service of Health Professionals, and the Family Physician Regulation. The overall objective of the thesis is to measure the extent to which all health professionals are aware of their rights and responsibilities in the legal context. Turkey's health care law to measure the scope of the regulations and laws in the context of health care workers and their level of knowledge about the adequacy of the legislation said they are working and of course the main objective is to create an awareness of them. The universe of the research is composed of health workers who work in three hospitals in the province of Sivas. It has been aimed to reach all of the doctors, nurses, midwives, health technicians / technicians who work in these institutions that have not been selected as sample in the research since they constitute the universe of research. The survey was conducted between 19.09.2016 and 19.03.2017 at Cumhuriyet University Education and Research Hospital, Sivas Numune Hospital and Private Medicana Sivas Hospital. The survey consisted of 7 demographic data and 14 legislative data. The validity of the survey was applied to a group of 30 people and afterwards 348 health workers were reached and applied. The result of the research is examined in two parts; the first part is the differences within the legislation and the second part is the evaluation of the significance relations between the answers to the questions on the demographic data.
