Dürerü’l-Hükkâm Şerhu Mecelleti’l-Ahkâm’ın Rehin Kitabının (701-728. Maddeler) Metninin ve Kaynaklarının Tespiti

Abstract

Bu tez, Ali Haydar Efendi’nin (ö. 1835/1935) Dürerü’l-Hükkâm Şerhu Mecelleti’l-Ahkâm adlı eseri esas alınarak yapılan bir çalışmadır. Dürerü’l-Hükkâm Osmanlı medeni hukuku sayılan Mecelle’nin en önemli şerhlerindendir. Çalısma iki bölümden oluşmaktadır. Birinci bölümde Ali Haydar Efendi’nin hayatı, ilmi şahsiyeti ve eserleri hakkında bilgi verilmiştir. Müellifin eseri kaleme alırken takip ettiği usûl üzerinde durulmuştur. Rehin kitabında (701-728. maddeler) geçen kaynaklar müellifleriyle birlikte tanıtılmıştır. Ayrıca Dürerü’l-Hükkâm ve bu eserin özellikle rehin kitabı ile ilgili genel bilgilere yer verilmiştir. Çalışmanın ikinci bölümünde ise Dürerü’l-Hükkâm’ın rehin kitabı latinize edilmiştir. Ayrıca bu şerhte yararlanılan eserler ve bazı yerlerde müellifine atıf yapılan kitaplar tarafımızdan tespit edilmiştir. Latinize çalışması sırasında metnin aslına sadık kalınmaya çalışılmıştır.

This thesis is based on the work of Ali Haydar Efendi’s (ö. 1835/1935) Dürerü’l-Hükkâm Şerhu Mecelleti’l-Ahkâm. This study is one of the most important explanations of Mecelle which is accepted Ottoman Civil Law. The study consists of two parts. In the first part, information is given about Ali Haydar Efendi’s life, his scientific study of knowledge and his works. Also in this part, it is focused on the author’s procedures that follow by process of his writings. In the “Rehin” book (701- 728. ) mentioned sources are informed with his authors. Also, general information was given about Dürerül Hükkam book that especially in its “Rehin” book part. In the second part of this study, Dürerül Hükkam’s Rehin book was latinized. Also in this part, it was only detected by us that his sources benefiting from it when the author wrote this description and the works that refer to the name. During the latinization process, it has tried to stay faithful to the original text.
