Egemenlik Kavramına Hukuki Ve Politik Bakış: Kelsen Ve Schmıtt
Abstract
Bu çalışmada, Alman siyaset ve hukuk felsefecisi Carl Schmitt ile
Avusturyalı hukuk filozofu Hans Kelsen’in düşünceleri egemenlik kavramı
ekseninde karşılaştırılmıştır. Siyasi ve hukuki düşünce tarihinde önemli bir yerde
duran ve “en üstün hükmetme gücünü” ifade eden egemenlik kavramı; iki dünya
savaşı arası dönemde farklı bakış açılarıyla ele alınmıştır. Weimar dönemi
Almanya’sının hukuki ve politik sorunlarına çözüm bulmaya çalışan ve yok olmaya
yüz tutmuş devlet otoritesini yeniden diriltmeye çalışan Schmitt, egemeni; “istisna
haline karar veren” olarak tanımlamıştır. Bu dönemde aynı hukuki ve politik
sorunlarla uğraşan Kelsen ise, hukuku tarafsız bir bilim haline getirerek istikrarın
hukukun egemenliği ile sağlanacağını düşünmüştür. Schmitt, kavrama “kararcı” bir
perspektiften bakarken Kelsen, kavrama “kuralcı” bir bakış açısıyla yaklaşmaktadır.
Çalışmanın ilk bölümünde egemenlik kavramının etimolojik tanımı ve siyasi
düşünceler tarihinde egemenlik kavramının gelişimi incelenmiştir. İkinci bölümde
Hans Kelsen’in “Saf Hukuk Kuramı” açıklanmış ve bu kuram temelinde Kelsen’in
egemenlik kavramına bakış açısı ortaya konmuştur. Üçüncü bölümde Carl Schmitt’in
temel eserleri bağlamında egemenlik kavramını yorumlaması ele alınmıştır.
Dördüncü ve son bölümde iki düşünürün egemenlik kavramına bakış açıları,
aralarında geçen tartışmalar da dikkate alınarak karşılaştırılmıştır. XX. yüzyılın bu
iki önemli düşünürünü anlamak; dönemin siyaset ve hukuk düşüncesine hâkim olan
entelektüel havayı solumamıza ve günümüz politik sorunlarına çözümler üretebilmek
için bir dayanak noktası bulmamıza yardımcı olacaktır. In this study, the thoughts of German philosopher of politics and law Carl
Schmitt and Austrian philosopher of law Hans Kelsen within the horizon of the
concept of sovereignty. The concept of sovereignty which expresses the supreme
power to rule and which occupies an important place in the history of political and
juridical thought was examined from different perspectives between two world wars.
Schmitt who tried to solve the juridical and political problems of Weimar Germany
and revive the fading state authority, defined the sovereign as “the one who declares
the state of exception”. Kelsen on the other hand who at the same period dealt with
the political problems thought that stability can be maintained through rendering law
an objective science with a view to reach the rule of law. Schmitt looks at the
concept from a “decisionist” persepective, while Kelsen approached it from a
“normativist” perspective. In the first chapter of this study, the etymological
definition of the concept of sovereignty and its development throughout the history
of political thought are analysed. In the second chapter, Kelsen’s “Pure Theory of
Law” is explained and on this basis Kelsen’s understanding of the concept of
sovereignty is examined. In the third chapter, Carl Schmitt’s treatment of the concept
of sovereignty is explained through his major works. Finally, in the fourth and last
chapter, sovereignty perspectives of both thinkers are compared by taking the debate
between them into consideration. To understand these two import thinkers of
twentieth-century will help us the prevailing political and juridical atmosphere of the
era and to be able to find a basis on which solutions to contemporary political
problems can be found.
