| dc.description.abstract | İslam hukukunda şahsın her türlü hakkı güvence altına alınmıştır. Bu haklar akitler içinde geçerlidir. Akitlerde tarafların haklarının korunması için sözleşmenin meşru bir şekilde kurulmasından sonra mahallin akdin muktezasına uygun olması gerekir. Akit mahalli; kendisi üzerinde şeriata uygun olarak sözleşme yapılan şeydir. Akitlerde mahal akdin yapısına göre farklılık göstermektedir. Bey akdinde mahal mebi, nikâh akdinde mahal karı kocanın birbirinden istifade etmesi, icare akdinde mahal aynın menfaati olmaktadır. Akitlerde mahalde bulunması gereken şartlar vardır. Bunların en başında mahallin mevcut olması gelmektedir. İslam hukukunda olmayan bir şeyin satışı yasaklanmıştır. İkinci şart mahallin malum olmasıdır. Akit mahalli tarafların niza ve tartışmaya düşmelerini engelleyecek şekilde bilinmesi gerekmektedir. Mahal konusundaki bilgisizlik garar olarak ifade edilmektedir. Mahalle ilgili üçüncü şart meşru olmasıdır. Bir şeyin akde mahal olması için onun hukuken istifade edilmesine müsaade edilmiş olması gerekmektedir. İslam hukukunun yenilmesi, içilmesi yahut kullanılmasına izin vermediği şeyler akde mahal olamazlar. Akit mahalliyle ilgili dördüncü şart mahallin tesliminin mümkün olmasıdır. Akitlerde mahallin teslimi akdin geçerlilik şartlarındandır. Eğer mahallin teslimi hususunda imkansızlık söz konusu olursa bu akdin geçersiz olmasına sebep olur. | en_US |
| dc.description.abstract | All kinds of rights of the individual are guaranteed in Islamic Law. These rights are also valid for agreements. In agreements, after setting a contract legitimately in order to protect the rights of the parties, the object must be in accordance with the justification of the agreement. Agreement object is the thing on which the contract is done in accordance with the Sharia. In agreements, the object changes according to the structure of the agreement. The object in the shopping is what is sold, the object in marriages is for husband and and wife to benefit from each other and the object in renting is the benefit of the good. In agreements, there are conditions to be found in the object. First of all, the object must be present. In Islamic Law, selling the things that are not present is forbidden. The second condition is that the object must be known. The lack of knowledge about the object is expressed as risk. The third condition about the object is that the object must be legitimate. In order for something to be an object, it must be allowed to be used legally. The things that are not allowed by Islamic Law to be eaten, drunk or used can not be an object for the agreement. The fourth condition about the agreement object is that delivery of the object must be possible. In agreements, delivery of object is the condition for the validity of the object. If impossibility is in question on the delivery of the object, this causes the agreement to be invalid. | en_US |
