89 Numaralı Sivas Şer’iyye Sicili Kayıtlarında Kangal

Abstract

Yüksek lisans tez konumuz 89 Numaralı Sivas Şer’iyye sicili kayıtlarında Kangal kazasıdır. İncelemiş olduğumuz defter, H.1321-1327 yılları arasında kayıtlara geçilmiş olan belgelerden oluşmaktadır. Osmanlı Devletinde adalet kavramı her dönemde mühim bir konu olmuştur. Bir çok alanda kayıtlar tutmaya önem veren Osmanlı Devletinde adaletin işleyişini tesis eden mahkeme kayıtlarına da ehemmiyet gösterilmiştir. Bu çalışmamız ile de Osmanı mahkemelerinde tutulan kayıtların örneğinde bu mekanizmanın nasıl işlediğini ve elde edilen bulgulardanda toplumsal yapı hakkında bilgilere ulaşılmak amaçlanmıştır. Yazmış olduğumuz tezimizin giriş kısmında da Şer’iyye Sicilleri ve Osmanlı hukuku hakkında genel bilgiler üzerinde durulmuştur. Devamında ise söz konusu çalışmamızın esasını oluşturan 89 numaralı Sivas Şer’iyye Sicili kayıtlarına göre yaptığımız genel değerlendirmeler ile Kangal kazasının içtimai ve iktisadi yapısı hakkında bir takım tespitlerde bulunulmuştur. Son olarak ise incelemesini yaptığımız 89 Numaralı Sivas Şer’iyye sicilinin günümüz Latin alfabesine transkripsiyon edilmiş metnini yazmış bulunmaktayız. Yaptığımız çalışmalar ile 89 Numaralı Sivas Şeri’yye Sicilinin tam transkipsiyonu sağlanmış, buradan elde ettiğimiz bilgilerden de anlaşıldığı üzere Kangal kazasının da klasik Osmanlı taşra yapısının izlerini bütünyle taşıdığı görülmüştür.

The topic of my postgraduate thesis is the Kangal district in the 89 court records of Sivas. The notebook which I have analyzed consists documents that had been recorded between the years H. 1321-1327. The concept of justice has always been an important issue in the Ottoman Empire. In the Ottoman Empire ,which establishes the functioning of the court records, keeping records in many areas are also important. In this study, it is aimed to reach information about the social structure in the findings obtained and how this mechanism work as an example of records in the Ottoman courts. In the introduction of my thesis, the court records and general informations about Ottoman law are emphasized. Afterwards, it has been made a number of observations about the general evaluations I have made according to the records of the number 89 Sivas court records which constitutes the basis my study and the conventional and economic structure of Kangal district.Lastly, I have written the transcribed text of the 89th court records of Sivas ,which we have examined, into the Latin alphabet of today. With my study, full transcription of the number 89 Sivas court records has been provided , as it can be understood from the information we obtained here Kangal district also carried the traces of the classical Ottoman provincial structure.
