Osmanlı polis komiseri Kayserili Ali Rıza Efendi’nin hayat ve hukuk mücadelesi (1868-1920

Abstract

Ali Rıza Efendi, XIX. yüzyılın son demlerinde Osmanlı polis teşkilatına girmiş, sahip olduğu temiz sicili sayesinde kariyer basamaklarını sağlam adımlarla tırmanmış, ancak hakkında polislik mesleğini kötüye kullandığına ilişkin verilen bir ihbar üzerine kendisini birdenbire teşkilatın dışında bulmuş biridir. Meslekten ihraç edilmeyi asla hak etmediğini düşündüğünden yıllarca sürecek olan bir hukuk mücadelesine atılmıştır. Mücadelesi sona erdiğinde haklılığı gün yüzüne çıkmış, dolayısıyla o mücadeleyi kazanmıştır. İşte bu çalışma Ali Rıza Efendi’nin yaşam ve kariyer öyküsünün yanında işaret edilen hukuk mücadelesine yoğunlaşmıştır. Osmanlı ve Emniyet Genel Müdürlüğü arşivlerinde Ali Rıza Efendi’nin biyografisini eksiksize yakın tarzda aktarmaya müsait hayli zengin bir belge topluluğu mevcuttur. Bir Osmanlı memurunun yaşantısını ayrıntılı bir şekilde aktarabilmek için gerekli olan tercümeihâl varakası, Devlet-i Aliyye-i Osmaniye Tezkiresi (nüfus kâğıdı) ve askerlik teskeresi gibi belgeler altmış kadar vesikadan oluşan Emniyet’teki sicil dosyası içerisinde mevcuttur. Osmanlı Arşivi’nde ise ona ve özellikle yukarıda işaret edilen hukuk mücadelesine ait vesikalara ulaşılmıştır. Bu tarz biyografik araştırmalarda o denli zengin bir belge koleksiyonu şahsın doğum, ölüm, evlilik, atama, terfi ve azil gibi olaylarla ilgili tarihlendirme hususunda çok defa birbiriyle çelişen bilgilerin ortaya çıkmasına sebebiyet vermiştir. Ancak Ali Rıza hakkında üretilen belgelerin zenginliğine karşın ihtilaf arz eden çok fazla bir bilgiye rastlanmamıştır. Bu sayede araştırmaya konu olan şahsın hayli ilgi çekici olduğu düşünülen yaşam öyküsünün ve yürüttüğü hukuk mücadelesinin kesintisiz bir surette aktarılabilmesi mümkün olmuştur. O öykü sayesinde ayrıca Osmanlı polis teşkilatındaki bazı değişim ve dönüşümleri takip edebilmek de mümkün olmuştur

Ali Rıza Efendi became one of the members of the Ottoman police organization in the late 19th century, climbed the career ladder with firm steps thanks to his clean personal record, but suddenly found himself outside of the organization upon a report given about him regarding abuse of policing profession. Considering that he never deserved to be dismissed from the profession, he embarked on a legal struggle that would last for years. When his struggle ended, his rightfulness came to light, therefore he won the struggle. This study focuses on the legal struggle pointed out besides Ali Rıza Efendi’s life and career story. In the Ottoman and Security General Directorate archives, a very rich document collection is suitable to convey the biography of Ali Rıza Efendi almost in full. Documents such as curriculum vitae, birth certificate and military service license, which are the necessary to convey the life of an Ottoman civil servant in detail, are available in the personal record file in the police department, which consists of sixty documents. In the Ottoman archive, documents about him and especially the legal struggle mentioned above have been reached. Such a rich collection of documents in this kind of biographical researches has often led to the emergence of discordant information regarding the dating of events such as his birth, death, marriage, appointment, promotion and dismissal. However, despite the richness of the documents produced about Ali Rıza, there was not much controversial information. In this way, it was possible to uninterruptedly convey the biography of the person subject to the research, which was considered very interesting, and the legal struggle he prosecuted. Thanks to that biography, it was also possible to follow some changes and transformations in the Ottoman police organization.
